Terms of Service
1. Agreement to Terms
By engaging PixelHive Creative for design services, you agree to these Terms of Service. These terms apply to all projects, proposals, and agreements between PixelHive Creative ("we", "us", "our") and the client ("you", "your").
2. Services Provided
PixelHive Creative provides design services including but not limited to:
- Graphic design and brand identity
- Logo creation and design
- Custom illustrations
- UI/UX design and prototyping
Specific services, deliverables, and timelines will be outlined in a separate project proposal or agreement.
3. Client Responsibilities
As our client, you agree to:
- Provide complete and accurate project information
- Respond to requests for feedback within agreed timeframes
- Make timely payments as outlined in the proposal
- Provide necessary materials and approvals
- Communicate clearly and professionally
4. Intellectual Property
Upon full payment, PixelHive Creative transfers ownership of the final design files to the client, including usage rights for the intended purposes outlined in the project agreement.
We retain the right to:
- Display the work in our portfolio and marketing materials
- Use the work for self-promotion
- Maintain copies of the work for our records
Source files (e.g., .ai, .psd, .fig) remain the property of PixelHive Creative unless specifically included in the project agreement.
5. Payment Terms
Standard payment terms include:
- 50% deposit required before work begins
- 50% balance due upon project completion
- Payment within 7 days of invoice receipt
- Late payments may incur additional fees
6. Project Timeline & Revisions
Each project includes:
- A defined timeline outlined in the project proposal
- A set number of revision rounds (typically 2–3)
- Clear milestones and checkpoints
Additional revisions beyond the agreed number may incur additional fees at our standard hourly rate.
7. Confidentiality
PixelHive Creative agrees to keep confidential all non-public information shared by the client during the project, except where required by law or where the information becomes publicly available through no fault of ours.
8. Limitation of Liability
PixelHive Creative's total liability for any claim arising from our services shall not exceed the total amount paid by the client for those specific services. We are not liable for indirect, incidental, or consequential damages.
9. Termination
Either party may terminate a project with written notice. Upon termination:
- Client is responsible for payment for all work completed
- PixelHive Creative will deliver completed work up to termination date
- Any deposits may be non-refundable if work has commenced
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, United States.
